The Union Cabinet has cleared the 2019 Muslim Women (Protection of Rights on Marriage) Bill, aimed at banning Triple Talaq or instant divorce, for legislation

The Union Cabinet approved a fresh bill to ban triple talaq on Wednesday on legalising the Muslim Women (Protection of Rights on Marriage) Bill, 2019, and will be tabled in this upcoming Lok Sabha session.

The bill aims at criminalising the practice of instant divorce or Talaq-e-biddat,and reinforcing the Muslim women’s rights in marriage.

Previously, Triple talaq was introduced in 2018 but the bill had lapsed in 2019 during the budget session of the Indian Parliament.

Soon after approving the Bill, the centre asserted, “‘Sabka Saath, Sabka Vikas, Sabka Vishwas’ has been the pivot of NDA government led by Prime Minister Narendra Modi.”  

Adding that the “Bill would ensure gender equality and gender justice to Muslim women. The Bill would also help in protecting the rights of married Muslim women and prevent divorce by practice of ‘talaq-e-biddat’ by their husbands.”

The centre confirmed that the Bill, which replaces the Muslim Women (Protection of Rights on Marriage) Second Ordinance, “will be introduced in the forthcoming session of the Parliament.”

If passed, the Bill would make the practice of triple talaq punishable by a fine and three years’ imprisonment. The Bill also demands payment of subsistence allowance for married Muslim women and dependent children.
